Making Money with Street Magic

Hey, I'm 17 years old and I'm wondering if it's legal to grab a deck of cards, head out to a busy public spot to perform magic, and then pass around a hat for tips. Of all the ways to make money performing magic, this is the one that excites me the most, because I think it's where I can have the most fun and interact with the audience.

From time to time, I perform street magic – not to be confused with busking or performing just anywhere on the street (the difference is in the audience).

In Madrid, only musicians in the city center are regulated. The rest is unregulated. However, you can't use sound amplifiers. You have to go completely unamplified, as they say.

The public advocate stated that it's a form of expression, meaning you can't go against freedom of speech. (But try explaining that to a cop!) Therefore, you can't charge for your performance. (Passing the hat is considered donations.)

This applies to all towns and cities (in theory).

My advice (it's what I do) is to go to City Hall in the town where you want to perform, ask at the permits department, explain your act, and they'll usually authorize you without any conditions. (Do this well in advance; they take their sweet time.)

In Spain, from what I understand, you don't have to declare income unless you're making over 400 euros a month.

This applies to both performers and beggars (yes, technically, if someone is panhandling on the street and earns over 400 euros, they'd have to declare it... it's absurd, but that was the rule, at least a few years back).

Beyond that, it really depends on each individual city and their specific ordinances regarding public street performances.

In some places, just performing on the street requires you to obtain permits from the local city council or municipal office.

So, you'd need to check with your local city hall.

I live in Madrid, and I heard that a permit is only required if you're performing with music. If you're not singing or playing instruments, that permit isn't valid. My question is, does that mean magic doesn't require any permit? Do you need a different kind, or is it simply not allowed at all? I often see people performing breakdance, and if the local police catch them, they get fined.

Hey there.

Normally (across Spain), you need a permit or license to perform in a public space for a set amount of time.

In my city, Ourense, both musicians and other artists (like mimes or human statues, for example) need to get one.

They give it to you for free, no big deal.

And it's for using a public space to perform an activity.

It needs to be reported to the local city hall because, due to various regulations (like safety codes), they need to know beforehand in case anything happens.

Though this is usually for shows that attract a large crowd.

The thing is, if you plan to take up a section of a public street (to focus your show on one spot and gather the biggest crowd), for a specific amount of time (fifteen minutes, half an hour, an hour, or more), I'm pretty sure there's a permit you need to apply for.

Call your city hall and ask, or talk to other street performers (who aren't musicians 😅).
